Terms of Use

Effective · Last reviewed

Read the first three sections even if you read nothing else: this site is information, not advice; the numbers can be wrong, late or missing; and everything here is provided as-is, at your own risk.

1. The plain-language disclaimer

The Maple Markets is a financial news and market-information publication. It is not an investment adviser, dealer, broker, portfolio manager, exempt market dealer, financial planner, accountant, tax adviser or law firm, and it is not registered as any of those things with any securities commission or regulator in any jurisdiction.

Nothing on this site is a recommendation, solicitation or offer to buy or sell any security, derivative, commodity, currency, digital asset or financial product, and nothing here is tailored to your objectives, your risk tolerance, your tax position or your circumstances, because we know none of them.

Every decision you make after reading this site is yours. Every gain is yours. Every loss is also yours. If you need advice, hire a licensed professional in your jurisdiction who owes you a duty and carries insurance. We owe you journalism, not a duty of care over your portfolio.

2. Artificial intelligence and automated content

We use automated and AI-assisted systems for translation, summarisation, headline generation, tagging, data normalisation, chart annotation, moderation and drafting support. Human editors review editorial output before publication as a matter of policy, but automated systems can and do produce errors, omissions, mistranslations, false precision, invented detail and confidently wrong statements.

AI-assisted or machine-translated text is provided for convenience. Where a translated version conflicts with the English original, the English original governs. Where an automated summary, tag, label, chart or derived metric conflicts with the underlying source document, the source document governs.

The Maple AI assistant is a conversational interface over our published content and market data. It is not an adviser, it is not a person, it has no duty to you, and it does not know your circumstances. Its answers are generated statistically, may be incomplete, out of date or fabricated, and are never a recommendation to buy, sell or hold anything. Do not submit confidential, personal or client information to it. We may log conversations to operate, secure, moderate and improve the feature, may rate-limit or suspend access for abuse or excessive use, and may change, degrade or withdraw the feature at any time. Availability of the assistant is not guaranteed and is subject to third-party model providers we do not control.

You must not treat any AI-generated or AI-assisted output on this site as verified fact, as professional advice, or as a substitute for reading the original filing, release or statistical publication. You agree that we are not liable for any loss arising from automated output, and that verifying anything you intend to act on is your responsibility, not ours.

3. Accuracy, interpretation and market data

Market data, quotes, charts, movers, heatmaps, sector performance, fundamentals, calendars and derived metrics come from third-party providers and public sources. They may be delayed, based on the previous close, adjusted, restated, unadjusted for corporate actions, incomplete, mis-mapped to the wrong symbol, stale, or simply wrong. Nothing here is an official exchange feed and nothing here is suitable for trading, execution, valuation, accounting, compliance or reporting purposes.

We do not audit our data suppliers, and we make no representation about the accuracy, completeness, timeliness, sequencing or fitness of any figure displayed. Data providers may impose their own terms; where their terms conflict with ours in respect of their data, theirs govern that data.

Interpretation: headlines, summaries, analysis, opinion, sentiment indicators, scores, rankings and "key numbers" are editorial interpretations, not statements of objective fact, and reasonable people may draw different conclusions from the same source. Forward-looking statements are inherently uncertain. Past performance never indicates future results.

4. Acceptance, eligibility and changes

By accessing, browsing, registering for, subscribing to or otherwise using this site, its feeds, its APIs, its newsletters or any related service (together, the "Service"), you agree to these Terms of Use, our Privacy Policy, our Financial Disclaimer and every policy linked from them, which together form a binding agreement between you and The Maple Index Inc. ("we", "us", the "Publisher"), which publishes The Maple Markets. If you do not agree, your only remedy is to stop using the Service immediately.

You must be at least 16 years old, legally capable of forming a binding contract, and not barred from using the Service under any applicable law or sanctions regime. If you use the Service on behalf of an organisation, you represent that you have authority to bind it, and "you" means both you and that organisation.

We may modify these Terms at any time. Changes take effect when posted with a revised date, except where applicable law requires notice, in which case we will give that notice. Continued use after that date constitutes acceptance. We may also change, suspend, limit, price, degrade or discontinue any part of the Service, permanently or temporarily, for anyone or everyone, with or without notice, without liability.

5. Your account

You must provide accurate registration information, keep your credentials confidential, and remain solely responsible for all activity under your account, whether authorised by you or not. Usernames are unique and are not transferable or renameable; we may reclaim, rename or suspend a username that impersonates a person, brand, issuer, regulator or employee, that is offensive, or that is squatted.

We may suspend, restrict, shadow-limit or terminate any account at any time, with or without notice or reason, including for suspected abuse, automated access, evasion of a prior ban, security risk, or conduct we reasonably believe exposes us or other users to harm or legal risk. You have no property right in an account, a username, a follower count, saved content or accumulated reputation.

6. Acceptable use

You will not: scrape, crawl, spider, harvest, mirror, frame, resell or systematically extract content or data except as permitted by our robots directives; use the Service to train, fine-tune, benchmark or ground a machine-learning model without our prior written permission; reverse engineer, probe, penetration-test, load-test, denial-of-service, or attempt to circumvent authentication, rate limits, paywalls, captcha or access controls; upload malware or automated agents; or interfere with any other person's use of the Service.

This does not restrict use of our own Maple Connect connector (https://themaplemarkets.ca/connect) with an AI assistant you have authorised on your account; that use is subject to the plan limits shown on your account page, and we may suspend a connection that abuses them.

You will not post content that is unlawful, defamatory, harassing, hateful, threatening, obscene, discriminatory, privacy-invading, infringing, deceptive, or that discloses another person's private information. You will not use the Service to manipulate a market, to promote a security in which you hold an undisclosed position, to run a pump-and-dump, ramp, wash, spoof or coordinated promotion scheme, to spread false or misleading statements about an issuer, to solicit investment, to give registrable advice without registration, or to commit or facilitate securities fraud of any kind.

Search engines and AI answer engines may crawl, index, quote briefly and cite this site to the extent permitted by our robots.txt directives, provided the publication is attributed and the answer links back to the source page. Any collection that exceeds those directives — bulk downloading, dataset construction, model training or fine-tuning, or building a substitute product from our content or market data — requires a written licence from us. We may block, rate-limit, watermark or legally pursue unlicensed automated collection, and nothing on this site is offered under an implied licence to any model developer.

7. User content, discussion and community

"User Content" means anything you submit, post, upload, transmit or display through the Service, including comments, replies, board posts, sentiment votes, reactions, reports, usernames, profile text, images and messages to us.

You retain ownership of your User Content. You grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid, transferable and sublicensable licence to host, store, cache, reproduce, adapt, translate, excerpt, summarise, moderate, distribute, publicly display and publicly perform your User Content in any medium now known or later developed, for operating, promoting and improving the Service, including in newsletters, social posts, quotations within articles, and aggregated or de-identified statistics. You waive, to the maximum extent permitted by law, any moral rights in your User Content.

You represent that you own or have all rights necessary to grant that licence, that your User Content is accurate to the best of your knowledge, that it does not infringe or violate anyone's rights, and that you have disclosed any position, compensation, relationship or interest that a reasonable reader would want to know about when evaluating what you posted.

We are not the author of User Content and we do not adopt, endorse, verify, validate, fact-check, rate, endorse the accuracy of, or vouch for any User Content, sentiment aggregate, poll result, follower count, upvote, engagement metric or user profile. Sentiment indicators and community metrics are automated tallies of unverified user input, are trivially gameable, are not surveys, are not research, and must never be read as a signal of anything other than what unverified people clicked.

Content moderation is discretionary, not contractual. We may remove, hide, edit, label, demote, delay, lock, unpublish or refuse any User Content, and may suspend any user, for any reason or no reason, without notice and without liability, including where content is lawful. Equally, we have no obligation to monitor, review or remove anything, and any voluntary moderation we do perform does not create a duty to moderate anything else. To the maximum extent permitted by law we are an intermediary hosting third-party expression and we claim every protection available to intermediaries under applicable law.

Disputes between users are between those users. If a user defames you, misleads you, front-runs you, doxxes you, sells you something or costs you money, your claim is against that user, not against us, and you release us from it.

8. Advertising, sponsorship, affiliates and third-party promotions

The Service contains or may contain advertising, sponsored articles, issuer-paid content, partner content, affiliate links, promotional units, newsletters featuring third-party offers, and links to third-party sites, apps, brokers, issuers, data providers and products. Commercial content is labelled in accordance with our Advertising Policy and Sponsored Content Policy.

Advertisers, sponsors, issuers and affiliates are independent third parties. We do not endorse, guarantee, verify, underwrite, audit, or accept responsibility for any advertiser, sponsor, issuer, promoter, offering, product, service, claim, projection, testimonial, price, term, availability or outcome presented in or through commercial content, even where that content appears on our pages, in our newsletters or under our branding. Any transaction, correspondence, subscription, deposit, investment or reliance is solely between you and that third party.

Any statement inside sponsored, issuer-paid, affiliate or advertising content is the statement of the party who paid for it, not ours. We may receive compensation — flat fees, CPM, CPC, revenue share, affiliate commissions, securities or other consideration — for publishing commercial content or for referrals, including where you click a link or open an account. That compensation may exist even where a specific disclosure is inadvertently omitted, and its existence is disclosed here for all such content.

You agree that we are not liable for any loss, damage, cost, deposit, fee, tax consequence, missed opportunity or investment loss arising from any advertisement, sponsored placement, promotion, affiliate link, third-party offer or third-party site accessed through the Service, and that your sole recourse is against the third party concerned. Third-party sites are governed by their own terms and privacy policies, which you should read.

9. Intellectual property

The Service, including its articles, translations, photography, illustrations, generated imagery, charts, datasets, compilations, code, design system, trade marks, logos and the name The Maple Markets, is owned by us or our licensors and protected by copyright, trade mark and other laws. Except as expressly permitted here, no licence is granted.

You may read, link to, and share short excerpts with attribution and a link for personal, non-commercial purposes. You may not republish full articles, build a substitute product from our content, redistribute market data, or use our marks without written permission. Copyright complaints go to legal@themaplemarkets.ca with the information required by applicable notice-and-takedown law; we may remove content and terminate repeat infringers.

10. No warranties

THE SERVICE, ALL CONTENT, ALL MARKET DATA, ALL AI-ASSISTED OUTPUT, ALL TRANSLATIONS AND ALL USER CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

To the maximum extent permitted by law we disclaim all express, implied and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, completeness, currency, timeliness, uninterrupted or error-free operation, freedom from harmful code, and any warranty arising from course of dealing or usage of trade. We do not warrant that any content is accurate, that any figure is correct, that any alert will fire, that any email will arrive, that any page will load, or that any defect will be fixed.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the excluded warranties are limited to the shortest period and narrowest scope permitted by that law, and the rest of this section remains in force.

11. Limitation of liability

To the maximum extent permitted by law, neither we nor our affiliates, owners, directors, officers, employees, contractors, contributors, authors, moderators, licensors, data providers or service providers will be liable for any indirect, incidental, special, consequential, exemplary, punitive or aggravated damages, or for any loss of profits, revenue, savings, goodwill, reputation, opportunity, business, data or investment value, however caused, under any theory of liability, and whether or not we were advised of the possibility.

This includes, without limitation, losses arising from: trading or investment decisions; reliance on any article, figure, chart, translation, summary, AI output, sentiment score or community metric; delayed, missing, stale, restated or incorrect market data; a failed, late, duplicated or mis-triggered price alert; unavailability, downtime, data loss or security incident; content posted or removed; moderation performed or not performed; account suspension or termination; and any advertisement, sponsorship, affiliate link, promotion or third-party site.

Our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you actually paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred Canadian dollars (CAD $100). You accept that this allocation of risk is a fundamental basis on which the Service is offered free of charge, and that these limits apply even if a limited remedy fails of its essential purpose.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or rights granted to consumers by mandatory law.

12. Indemnity

You will defend, indemnify and hold harmless the Publisher and its affiliates, owners, directors, officers, employees, contractors, contributors and moderators from and against all claims, demands, actions, investigations, liabilities, damages, penalties, losses and costs, including reasonable legal fees on a full-indemnity basis, arising out of or connected with your use of the Service, your User Content, your breach of these Terms or any policy, your violation of law or of any third party's rights, or any dispute between you and another user or a third party. We may assume exclusive control of any matter subject to indemnity, and you will cooperate.

13. Governing law, disputes and time limit

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

The courts of Ontario have exclusive jurisdiction, and you irrevocably attorn to their jurisdiction and waive any objection based on venue or forum non conveniens, except where mandatory consumer-protection law in your place of residence entitles you to bring proceedings locally.

To the maximum extent permitted by law, you agree that claims will be brought individually and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding, and you waive any right to a jury trial. Any claim relating to the Service must be commenced within one (1) year after the claim arose, or it is permanently barred.

14. Paid subscriptions, billing and cancellation

Some features are offered on paid plans (Reader is free; Member and Pro are paid). Prices are shown in Canadian dollars before tax unless stated otherwise, and applicable GST/HST or other sales taxes are added at checkout. Payments are processed by a third-party payment processor; we do not receive or store your full card details, and the processor's own terms and privacy policy apply to the payment itself.

Paid plans renew automatically for successive terms at the then-current price until cancelled. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period and access continues until then. We may change plan pricing or plan contents on notice before the start of your next renewal term; continuing after that date is acceptance of the new price.

Except where a non-waivable consumer-protection law says otherwise, fees already paid are non-refundable and there are no partial-period refunds, including where you cancel early, stop using the Service, are suspended or terminated for breach, or where a feature is degraded, delayed or withdrawn. Where a payment fails, is reversed or is charged back, we may suspend paid features immediately.

Paid features — including advanced alerts, exports, deeper AI analysis, and any market data described as faster, extended or enhanced — are delivered on a commercially reasonable efforts basis with no uptime, latency, completeness or accuracy guarantee. Unless a page expressly states that a specific feed is licensed real-time exchange data, all quotes and derived figures remain delayed or previous-close. Paying us does not create an advisory, fiduciary or brokerage relationship of any kind, and Section 11 (Limitation of liability) applies in full to paid plans.

Free trials, promotional pricing, grandfathered rates and beta features may be modified or withdrawn at any time. Access granted in error, obtained through abuse of a trial or promotion, or shared beyond a single user may be revoked without refund; a subscription is for one named individual and may not be shared, resold or used to redistribute our content or data.

15. General

If any provision is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed, and the remainder stays in force. No failure or delay in enforcing any right is a waiver of it. You may not assign these Terms; we may assign them freely, including in a merger, financing or sale of assets. These Terms, plus the policies referenced in them, are the entire agreement and supersede prior understandings. Sections that by their nature should survive termination — including licence grants, disclaimers, limitation of liability, indemnity and dispute resolution — survive.

We are not liable for any failure or delay caused by events beyond our reasonable control, including outages, provider failures, exchange or data-feed interruptions, cyber attacks, power or network failure, strike, war, epidemic, natural disaster, regulatory action or change in law.

These Terms are written in English. Translated versions are provided for convenience only, and the English version governs any inconsistency. Questions: legal@themaplemarkets.ca.
