A Seville Court Restarts Emerita Resources' Aznalcóllar Case After a Quarter That Used C$6.4 Million of Cash
The High Court of Justice of Andalusia lifted a suspension in place since November 2018, which restarts the case rather than deciding it, and the deposit Emerita actually owns sits an hour's drive west in Huelva with C$9.1 million of cash behind it.
Emerita Resources said on September 11, 2026 that the High Court of Justice of Andalusia had lifted the suspension of the administrative case over the Aznalcóllar tender, frozen since November 2018. That restarts the case; it does not decide it, and Emerita does not own Aznalcóllar. What it owns is an 18.96 million tonne indicated resource in Huelva, a June 30 cash balance of C$9.1 million after a quarter that used C$6.4 million, warrants struck at C$1.30 against a C$0.33 share price on delayed market data, and an unresolved proceeding before Ontario's Capital Markets Tribunal.

Administrative proceeding
Ordinary Procedure 528/2015, suspension lifted by order dated September 9, 2026
suspended since November 21, 2018; no judgment date given.
A court in Seville let a case frozen for almost eight years start moving again this week. It did not decide the case. Emerita Resources Corp. (TSXV: EMO) announced on September 11, 2026 that it had been notified of an order dated September 9 from the High Court of Justice of Andalusia, the TSJA, lifting the suspension of Ordinary Procedure 528/2015. That is the administrative case examining whether there were irregularities in the award of the Aznalcóllar mining tender. Lifting a suspension restarts a case that had been frozen; it does not rule on it.
The freeze had been in place since November 21, 2018, pending the criminal trial of the same facts. The company states the court found there were no longer grounds to maintain it, and that no date has been given for judgment.
The order lands on a company whose nearest clock is not in any courtroom but on its balance sheet. And the ground Emerita owns is not Aznalcóllar. It is an hour's drive west, in the province of Huelva.
The cash has a date on it and the court case does not
Cash burn is the money a company spends in a period beyond what it brings in, and runway is how long the bank balance lasts at that pace. Emerita held cash of C$15,561,311 at March 31, 2026. At June 30, 2026 it held C$9,123,005. The difference is C$6,438,306, or roughly C$6.44 million gone in one quarter. Working capital, the short-term assets left after short-term bills, went the same way: C$17,109,172 at March 31 to C$10,914,734 at June 30, about C$6.19 million consumed. The net loss for the quarter was C$4,171,405, and C$10,833,435 for the nine months. (Emerita MD&A, period ended June 30, 2026)
Over the nine months, most of the spending went into the ground: exploration was C$11,995,778, and C$11,963,025 of it went to the Iberian Belt West project. That is about C$4 million a quarter on exploration alone. Set C$9.1 million of cash beside a quarter that used C$6.4 million and the June balance does not cover two more quarters like it. One quarter is a short sample and the pace can change.
The last financing shows the problem. It closed on August 26, 2025 at C$1.05 per unit. Each unit carried half a warrant, and each whole warrant is exercisable at C$1.30 until August 26, 2027. A warrant only brings cash in if the share price is above that strike. The shares were at C$0.33 after the close on September 11, 2026, per 15-minute delayed market data not verified against SEDAR+, so those warrants are far out of the money and will not fund the next programme.
There is also a long-term loan payable of US$9,000,921 in the June 30, 2026 statements. A company spending about C$4 million a quarter on exploration, holding C$9.1 million of cash, with no warrants anyone would exercise, is a company whose next financing is a live question, whatever the court does.
What the market pays for the rock, worked out per tonne
The same after-close market data showed the shares up 1.5 per cent on the day, with 296.62 million shares outstanding and a market value of about C$97.9 million. Those are 15-minute delayed secondary figures, not verified against SEDAR+.
The rock behind that value is a resource of 18.96 million tonnes in the indicated category at 8.44 per cent zinc equivalent. Indicated means the geology and grade are estimated with enough confidence to support a study that has economic assumptions in it. Multiply the tonnes by the grade and the deposit holds 1.60 million tonnes of contained zinc equivalent. Divide C$97.9 million by 1.60 million tonnes and the market is paying roughly C$61 for each contained indicated tonne.
Every piece of that number has a limit. Zinc equivalent folds five metals into one grade using assumed prices and recoveries. Contained metal is what sits in the ground, not what a mill would recover. No economic study has been published. And a resource is not a reserve, because a reserve needs a study showing the rock can be mined at a profit.
The shares trade on the TSX Venture Exchange as EMO and in Frankfurt as LLJA, WKN A2PKVQ, ISIN CA29102L4064, per the Deutsche Börse equity page, and the company carries the FSE symbol in its own release boilerplate. (Deutsche Börse) The Tradegate order book for the same ISIN, checked September 11, 2026, showed a non-binding quotation flagged as suspended from trading in the Freiverkehr, the open-market segment. The German line is a route into a Canadian venture security whose liquidity is in Toronto.
Aznalcóllar is a lawsuit; Iberian Belt West is a deposit
The Aznalcóllar proceedings have run in two lanes. On December 5, 2025 the Third Section of the Provincial Court of Seville concluded the criminal case and declined to impose criminal convictions on any of the accused. Emerita announced on December 17, 2025 that it would not appeal to the Supreme Court and would instead ask the administrative court to complete its ruling. On December 18, 2025 it requested that the suspension be lifted.
On September 9, 2026 that request succeeded. The administrative appeal, which the company says was substantially complete except for judgment when it was frozen in 2018, is live again. The TSJA will now examine whether the tender award of 2014 and 2015 was lawful as an administrative act.
Three things are true at once. The company's own counsel estimated in December 2025 that an administrative resolution would come within two to three months; nine months later the court had only just lifted the suspension. No ruling on the merits exists. And any TSJA ruling would itself be open to appeal to Spain's Supreme Court. This week's order was not a win. It was not nothing either. A case that could not move can now move.
Emerita does not own Aznalcóllar. It is litigating for the right to develop it. The deposit it does own is in the Iberian Pyrite Belt, in Huelva.
The deposit Emerita holds: 18.96 million tonnes, indicated

The estimate has an effective date of February 26, 2025. It was prepared by Frank Browning, Principal Resource Geologist at Wardell Armstrong International, and rests on 105,554 metres of drilling in 299 holes. The cut-off grade, the lowest grade counted into the resource, is 3.0 per cent zinc equivalent at La Romanera and La Infanta and 0.9 per cent copper equivalent at El Cura, and only primary sulphide mineralisation, the unoxidised sulphide material below the weathered zone, is included. (GlobeNewswire, March 17, 2025)
Inferred, the other class in the table, means the confidence is lower, and an inferred resource cannot support a reserve or the economics of a prefeasibility or feasibility study; it can appear only in a preliminary economic assessment, with a caution that it is too speculative for economic considerations to be applied. The difference between those two words is the difference between a number an engineer may build on and a number a geologist finds encouraging.
The MD&A states the company expects to publish a prefeasibility study during the third quarter of 2026. A prefeasibility study is an economic study detailed enough to support declaring mineral reserves; it sits above a preliminary economic assessment and puts capital and operating cost estimates on the resource. The quarter ends this month. No study has been published.
Two Spanish risks that a ruling on a 2015 tender would not settle
Permitting on this ground is contested. In December 2020 the municipalities of Paymogo and Puebla de Guzmán issued technical directives stating that mining exploration in the La Romanera area is not compatible with municipal planning. The directives stated that much of the terrain is classified as non-developable land under special protection, and that the Province of Huelva's Special Plan for Environmental Protection forbids extractive operations where the deposit sits.
During the environmental authorisation process for the Romanera and El Cura drill permits, Ecologistas en Acción filed a submission within the public comment period, which closed on February 18, 2022. Those objections attached to exploration drilling. A mine would need an exploitation licence, and none has been identified in the company's documents as of September 11, 2026.
Against that sits support from the same region. On August 17, 2026 Emerita was awarded €108,877 by the Andalusian Business Agency for Economic Transformation and Development for the IBW-3METAu project. The grant covers 35 per cent of eligible costs on a €311,077 budget, under the Andalusia ERDF 2021-2027 programme, an EU regional development fund, with 85 per cent EU co-financing, and runs 23 months at Puebla de Guzmán. The work aims to improve concentrate quality and recover antimony, which the European Union lists as a critical raw material.
It is a small sum, and a real signal about where this deposit sits in EU industrial policy.
An Ontario proceeding and a boardroom that changed this week
On April 9, 2026 the Ontario Securities Commission filed a Statement of Allegations before the Capital Markets Tribunal naming Emerita Resources Corp. and six individuals, including its chief executive. The Capital Markets Tribunal is the Ontario body that hears the cases the securities regulator brings, and a Statement of Allegations is the regulator's accusation, not a finding against anyone. (Capital Markets Tribunal, April 9, 2026)
The allegations concern the diversion of the Falcon lithium project in Brazil to another issuer between May 2021 and May 2022, and misleading disclosure about the Plaza Norte property in Cantabria between October 2017 and May 2023. That includes a permit described as valid after it had expired in January 2020, with renewal denied in February 2020. The allegations are unproven and have not been tested. The company set up a special committee of independent directors.
The boardroom has been under strain too. At the annual meeting on August 25, 2026 all six nominees were elected, but withheld votes exceeded votes in favour for three directors. Each of the three tendered a resignation under the company's majority voting policy, which asks a director with more votes withheld than in favour to offer to resign. The chair resigned on September 9, 2026, and Joseph Belan was appointed executive chairman the same day. (Newsfile, August 25, 2026)
Streetwise Reports discloses on its Emerita page that the company "is a billboard sponsor of Streetwise Reports and paid a fee for this company profile page". Commentary published there is paid-relationship content, not independent research.
Two stories, and only one of them is being built
The Aznalcóllar case is a lottery ticket with a decade of legal history behind it and no date on it. The market has been pricing it for years, which is why a procedural order moved the shares by one and a half per cent rather than by fifty. Meanwhile the company has spent nearly C$12 million in nine months proving up 18.96 million indicated tonnes it already controls, inside the EU, with an EU co-financed metallurgical grant attached. That is the side of this business being built rather than argued about.
What I will not smooth over is the arithmetic at the top. C$9.1 million of cash against a quarter that used close to C$6.4 million. Warrants struck at nearly four times the market price. A prefeasibility study promised for a quarter that ends this month, still unpublished. A regulator's unproven allegations against the company and its chief executive. Those are the open items that go into the next financing conversation, and the price and terms of that financing will say more about this company's access to capital than any court order.
Dated things would change the picture. A published prefeasibility study on Iberian Belt West is the largest. Next, the financing itself. Then the TSJA judgment, whichever way it goes, remembering that an appeal to the Supreme Court would follow a loss and possibly a win. Then the Andalusian authorities granting an exploitation licence, or refusing one. And underneath all of it runs the Capital Markets Tribunal proceeding, on its own timetable and with its own consequences.
Nearly eight years of suspension ended with a written order from Seville this week. The clock that matters to this company is quieter than that: it ticks on a bank balance, in quarters, not years.
